Obtaining Temporary and Permanent Residence Permits in the Republic of Azerbaijan

Requirements and Procedures for Obtaining a Temporary Residence Permit in the Republic of Azerbaijan

Foreigners and stateless persons wishing to temporarily reside in the Republic of Azerbaijan must obtain the relevant residence permit. This permit is issued by the State Migration Service of the Republic of Azerbaijan. Once granted, the individual is issued a Temporary Residence Permit Card by the State Migration Service.

The Temporary Residence Permit Card serves as an official document confirming the individual's legal right to reside temporarily in Azerbaijan. It also allows the permit holder to leave and return to the Republic of Azerbaijan without obtaining a visa during the validity period of the permit. Additionally, it confirms the individual's identity and registration at a specific place of residence within the country.

Conditions for Obtaining a Temporary Residence Permit

  1. When in close kinship relations with a citizen of the Republic of Azerbaijan (according to Article 3.0.12 of the Migration Code, close relatives include parents, spouse, children, siblings, and their children, grandparents, and great-grandparents, grandchildren, father-in-law, mother-in-law, brother-in-law, and sister-in-law)
  2. In cases specified in Articles 45.1.3-45.1.3-2 of the Migration Code, when the total investment amount in the country's economy is at least 500,000 AZN (300,000 USD)
  3. When owning real estate in the Republic of Azerbaijan valued at no less than 100,000 AZN (60,000 USD)
  4. When depositing at least 100,000 AZN (60,000 USD) in a time deposit account with banks operating in Azerbaijan
  5. When holding state securities with a nominal value of at least 100,000 AZN (60,000 USD) or investment securities of legal entities where 51% or more of the shares are state-owned
  6. When being a highly qualified specialist in fields such as economics, industry, military, science, culture, sports, and others
  7. When being a specialist or highly qualified migrant as outlined in Article 64.0.8-1 of the Migration Code
  8. When being family members of foreigners or stateless persons residing temporarily or permanently in the Republic of Azerbaijan (including the spouse of the foreigner or stateless person, children under 18, adult children without the capacity to work, and dependent parents)
  9. When being the head or deputy of a branch or representative office of a foreign legal entity in the Republic of Azerbaijan
  10. When holding the position of head of a legal entity established in the Republic of Azerbaijan with a paid charter capital of not less than the amount approved by the Ministry of Economy of the Republic of Azerbaijan (50,000 AZN = 30,000 USD), with at least one founder being a foreign legal or natural person, or owning at least 51% of the shares of that legal entity (with an annual turnover of 100,000 AZN)
  11. When engaging in entrepreneurial activities in the Republic of Azerbaijan
  12. In cases specified in Articles 64.0.6, 64.0.6-1, 64.0.7, 64.0.9, 64.0.10, 64.0.11, 64.0.17, 64.0.18, and 64.0.19 of the Migration Code
  13. When obtaining a work permit in accordance with the procedures established by this Code for engaging in paid employment in the Republic of Azerbaijan
  14. When studying in full-time programs at higher and secondary vocational educational institutions, as well as in vocational education and general education institutions
  15. When engaging in professional religious activities in religious organizations registered with the state
  16. When recognized as a victim of human trafficking
  17. When providing assistance to law enforcement agencies
  18. When there are grounds specified in international treaties of the Republic of Azerbaijan

Important Notes

The circumstances outlined in Articles 45.1.7 and 52.1.11 of the Migration Code are considered grounds for granting a temporary or permanent residence permit in the Republic of Azerbaijan if the individuals engage in actual activities by employing at least 5 persons under full-time conditions or 10 persons under part-time conditions. It is required that at least 80% of these employees are citizens of the Republic of Azerbaijan or fall under the categories specified in Articles 64.0.1, 64.0.14, 64.0.15, 64.0.15-1, and 64.0.16 of the Migration Code.

For foreigners and stateless persons who have resided temporarily in the Republic of Azerbaijan for at least 1 year based on the conditions specified in Articles 45.1.6-1 or 45.1.7, these circumstances are considered grounds for issuing (or extending) a temporary residence permit, provided their turnover meets the volume determined by the Ministry of Economy of the Republic of Azerbaijan.

Regarding the charter capital specified in Article 45.1.6-1 of the Migration Code, the requirements mentioned in points 1 and 2 of this Note do not apply to business entities operating in economic zones designated by the President of the Republic of Azerbaijan, as well as to non-commercial legal entities, residents of industrial parks, industrial districts, and agro-parks that possess an investment promotion document or a "Startup" certificate.

Requirements and Procedures for Obtaining a Permanent Residence Permit in the Republic of Azerbaijan

  1. Foreigners and stateless persons who have resided temporarily in the Republic of Azerbaijan for the last 2 years continuously (under the same grounds) based on the relevant permit, except for those temporarily residing due to being family members of foreigners or stateless persons as outlined in Articles 45.1.8-45.1.11 of the Migration Code
  2. When their father, mother, spouse, child, sister, or brother is a citizen of the Republic of Azerbaijan
  3. When the total amount of investment made in the country's economy is at least 500,000 AZN, considering the circumstances outlined in Articles 52.1.3-52.1.5 of the Migration Code
  4. When owning real estate in the Republic of Azerbaijan valued at no less than 200,000 AZN (120,000 USD)
  5. When having at least 200,000 AZN (120,000 USD) in a time deposit account with banks operating in the Republic of Azerbaijan
  6. When holding state securities with a nominal value of at least 200,000 AZN (120,000 USD) or investment securities of legal entities where 51% or more of the shares are state-owned
  7. When being a highly skilled specialist in areas such as economics, industry, military, science, culture, sports, and other fields
  8. When being a specialist or highly skilled migrant as specified in Article 64.0.8-1 of the Migration Code
  9. When being a family member of a foreigner or stateless person permanently residing in the Republic of Azerbaijan
  10. When serving as the head or deputy of a branch or representative office of a foreign legal entity in the Republic of Azerbaijan
  11. When holding the position of head of a legal entity established in Azerbaijan with a paid charter capital of at least the amount approved by the Ministry of Economy of the Republic of Azerbaijan (not less than 60,000 USD), where at least one founder is a foreign legal or natural person, or owning at least 51% of the shares of that entity, provided that the entity's turnover meets the volume determined by the Ministry of Economy (annual turnover of 200,000 AZN)
  12. When engaging in entrepreneurial activities in the Republic of Azerbaijan, provided that the turnover meets the volume determined by the Ministry of Economy (for foreigners or stateless persons engaging in entrepreneurship, the turnover for temporary residence permit issuance or extension is set at 50,000 AZN, and for permanent residence permit issuance or extension at 100,000 AZN)

Permanent residence permits for foreigners and stateless persons in the Republic of Azerbaijan are issued by the State Migration Service of the Republic of Azerbaijan. Upon receiving a permanent residence permit, individuals are provided with a certificate confirming their right to reside permanently in the country.

The permanent residence permit certificate grants foreigners and stateless persons the right to leave the Republic of Azerbaijan and return without a visa during the validity period of the permit, as well as serving as a document confirming their identity and residence registration within the country.

Important Notes

  • The period of temporary residence in the Republic of Azerbaijan is considered continuous if the individual does not stay outside the country for more than 90 days within a 180-day period.
  • The list of individuals who have obtained a permanent residence permit by having at least 200,000 AZN in a time deposit account with banks operating in Azerbaijan is sent by the State Migration Service to the relevant bank within 3 working days. If the amount of the deposit falls below 200,000 AZN or if the deposit agreement is terminated, the bank must inform the State Migration Service within 3 working days.
  • The list of individuals who have obtained a permanent residence permit by holding state securities or investment securities of legal entities where 51% or more of the shares are state-owned is sent by the State Migration Service to the National Deposit Center within 3 working days. If the total nominal value of these securities falls below 200,000 AZN or if they are transferred to another party, the National Deposit Center must notify the State Migration Service within 3 working days.
  • The circumstances specified in Articles 52.1.7 and 52.1.9-52.1.11 of the Migration Code are considered grounds for issuing a permanent residence permit if the individuals have lived in the Republic of Azerbaijan for the last 2 years under the relevant permits outlined in Articles 45.1.4-1 and 45.1.6-45.1.7 of the Migration Code.
  • The requirements regarding charter capital and turnover specified in Article 52.1.10 of the Migration Code do not apply to non-commercial legal entities.
